The tactical methods of overcoming the false testimony Abstract The topic of the thesis are tactical methods of overcoming a false testimony, meaning the approaches which can an interrogator use within interrogation to overcome a false motivation and gain a truthful statement from interrogated. In the first chapter the author focuses on the concept of interrogation as an interdisciplinary term in course of which knowledge from several scientific fields is applied, while stating for what reasons it is necessary to understand and approach interrogation in this way. The author mostly focuses on the problematic of interrogation from the view of criminalistics, analyzes the individual phases of an interrogation and their significance for detecting and overcoming a lie. The second chapter is dedicated to the very essence of lie and false testimony. Here, the author tries to define a false testimony and define which manifestations of lie in communication and behavior of a person are still acceptable today for determining if the person is giving a false or truthful testimony. Tactical methods of overcoming false testimony Abstract The topic of this diploma thesis is tactical methods of overcoming false testimony. This diploma thesis aims to map and analyze selected criminal-tactical procedures used to overcome false testimony, as well as some other methods of overcoming false testimony, whether permitted or not, and to define the mechanism of their operation, especially with regard to their use in the Czech Republic. The diploma thesis concludes with a discussion of a specific and controversial tactical procedure used to overcome false testimony, which is the lie detector. The diploma thesis is organized into four chapters and their subchapters. The first chapter deals with basic terminology and its definition. It defines the concept of interrogation and testimony, false testimony including the manifestations on the basis of which a lie can be detected in a testimony, the concept of credibility and truthfulness, as well as the different types of interrogation according to the classification criteria of complete and credible testimony. The tactical methods of overcoming the false testimony Abstract The objective of this thesis is to describe and analyse the false testimony at interrogation, its recognition and follow-up overcoming by means of tactical interrogation methods and other techniques. In the introductory part of the thesis, the elemental concepts such as the phenomenon of lie, interrogation and testimony are defined in order to gain some insight, without which it would not be well possible to dedicate to the research of detection of lie and its overcoming. The following part deals with the lie detection in crime investigation in particular, it highlights the importance of correct identification of false testimony and it pursues the lie from perspective of the recipient of lie, whose interest is to reveal the lie. The particularities in this area regarding children are outlined as well. The subsequent part is focused on the false testimony and its detection based on the verbal, nonverbal and paraverbal tokens in conduct of concerned person. I have attempted to capture the differences between intentional communicating of untruthful information, thus lying, and unintentional communicationg of untruthful information caused by natural process of forgetting. The purpose of my thesis is to explore and discuss interrogation tactics. Interrogation tactics is a concept that includes various methods used by interrogators to reach the goal of the interrogation, which is true and full testimony. Considering the extent of the topic, I am focusing more closely on the techniques used for the purpose of overcoming false testimony. The thesis is composed of nine chapters. In the opening chapters I explain the concept of interrogation from three perspectives - from the perspective of criminology, psychology and law. These chapters also describe different types of interrogation, as well as the process of documentation and the process of formation of testimony. The fifth chapter recognizes the issues of the preparation phase and its division into analytic and synthetic part. In this chapter I also emphasize the importance of expert and thorough preparation in order to ensure a successful interrogation. The sixth chapter presents three consecutive phases of interrogation, which are the initial phase and the phases of monologue and dialogue. This is the construction of interrogation that affects individual tactical methods.
